Your Rights and Responsibilities

If a primary residential parent wants to move out of state or more than 100 miles out of the jurisdiction of the court, they must give official notice to the other parent within 60 days of the move. If the other parent wishes to oppose the move, they must file an objection with the court within 30 days.

How will the Court Decide?

The court will determine if the move is in the best interests of the child. Frequently, the court will grant the primary residential parent the right to move unless the court believes that the move is motivated by spite or an attempt to alienate the non-residential parent from the child.
