Mediation of Family Law Disputes

The family law attorneys at Joy Davis Collier, PLLC believe strongly in the value of mediation and alternative dispute resolution (ADR) measures. In our family law practice, we work diligently to resolve disputes as amicably and cost-effectively as possible, while fully protecting our clients' rights and interests.

We represent our clients in family law mediations, including divorce mediation, custody mediation and visitation mediation. Many disputes can be resolved effectively through the process of mediation and we will be there for our clients throughout every step in the process.

The Mediation Process

In the state of Tennessee, mediation is a required step in divorce cases. Typically, parties to the divorce are represented by separate legal counsel, and a neutral mediator is chosen to listen to the two sides and attempt to facilitate an agreement between the parties.

While the mediator is neutral, the mediator is not a legal advocate and is not required to advise individuals of their rights or protect their legal interests. If you are getting a divorce and you must attend mediation, it is important that you retain a knowledgeable family law attorney who can protect your financial and parental rights.

The mediator is a facilitator of communication. The mediator's job is to listen to the parties, communicate with the parties, and help them resolve disputes. The ultimate goal of the mediator is to assist the parties in reaching an agreement that avoids the necessity of trial or a contested hearing.

The Value of Mediation

Taking a case to trial is timely, costly and risky. Tennessee law grants judges considerable discretion in making determinations regarding property division, child custody and visitation.

When your property and your parental rights are at stake, you do not want a judge who is unfamiliar with your family to determine your future. You want to put your future in your own hands in order to reach an agreement that protects your rights and interests. In many cases, the process of mediation can result in an agreement between the parties that is preferable to the time, cost, acrimony and uncertainty of going through a trial.
